Declaration of Operative Flow Order (“OFO”)
This Operative Flow Order is effective for all Mexico Transportation Agreements as provided in Section 16 of the General Terms and Conditions (the “GTCs”).
Kinder Morgan Gas Natural de Mexico, S. de R.L. de C.V. (“Kinder Morgan”) hereby notifies transport customers that given the weather conditions forecasted in the United States and per the Operational Balancing Order issued by the upstream pipeline, Kinder Morgan needs to institute an Operative Flow Order, effective as of 9:00 am central time January 24, 2026, and until further notice.
Control Measures:
a) While the OFO is in place, the imbalances provisions of applicable agreements are suspended and all receipts and deliveries under transportation agreements are required to be balanced
b) Kinder Morgan may issue specific instructions for certain Users/Delivery Points, based on their risk level with respect to this OFO
c) If necessary, Kinder Morgan will request certain users to adjust nominations in order to maintain the integrity of the system.
Shipper's obligations:
a) Maintain strict adherence to consumption according to the scheduled quantity until further notice.
b) Adjust consumption according to the hourly flow rate of 1/24, with respect to the scheduled quantity GD24 and subsequent periods.
Kinder Morgan will post a notice once the OFO ends.
